Satisfaction Guarantee Terms (7-day trial)
Effective from: 25 August 2026
These terms set out the rules of the 7-day satisfaction guarantee available when purchasing The Swarm subscription through theswarm.pl. They supplement the subscription terms and apply only to the first billing period.
§1. General provisions
- The service provider is BIG GROWTH Spółka z ograniczoną odpowiedzialnością, ul. Lipowa 3D, 30-702 Kraków, NIP: 6793284750, REGON: 527118883, KRS: 0001073383 (the “Service Provider”).
- For guarantee enquiries: [email protected].
- The guarantee is available exclusively to businesses (B2B).
§2. Subscription
- The Swarm subscription is a recurring service under which the Service Provider implements AI agents, automations or internal systems for the Client each month, and monitors and maintains the implemented solutions.
- The subscription costs 4 900 PLN net per month. Payment is collected in advance at the start of each billing period: the first period is paid against a pro forma invoice; for each subsequent period, a VAT invoice is issued on its first day, with a 7-day payment term. Available payment methods (BLIK, Visa, Visa Electron, Mastercard, MasterCard Electronic and Maestro cards, instant online bank transfer and standard bank transfer) and refund rules are set out in §3 of the Service and Subscription Terms.
- The subscription may be paused or cancelled without a notice period. A request submitted no later than the day before the next billing period starts ends the cooperation at the end of the current period. If an invoice for the next period has already been issued, it remains payable and the agreement ends at the end of the period it covers (§3(6) of the Terms).
§3. Satisfaction guarantee — 7-day trial
- If the Client is not satisfied with the cooperation within the first 7 days of the first billing period (counted from the date the first payment is credited), the Client may submit a cancellation request covered by the refund guarantee.
- In that case, the Service Provider refunds 3/4 (75%) of the first month’s fee, i.e. 3 675 PLN net. The Service Provider retains the remaining 1/4 (25%), i.e. 1 225 PLN net, as payment for work performed during the trial period.
- In practice, this means you can try The Swarm subscription for one week for 1/4 of the price (1 225 PLN net).
- To use the guarantee, send a request to [email protected] within the 7-day period referred to in section 1.
- The refund is made using the same payment method used by the Client — for a card transaction, to the bank account linked to that card, or, for a standard bank transfer, to the account from which the payment was received — within 14 days of confirming the request. The refund is free of charge.
- The guarantee applies only once and only to the first billing period. It does not cover subsequent months or a later rejoining of the subscription.
- The guarantee does not apply to the introductory package (§3(3) of the Terms), in which the first billing period is shortened to 14 days and the fee is reduced by half. In this package, the shorter, lower-priced period serves as the trial.
In brief: you have 7 days to try The Swarm. If you are not satisfied, email [email protected] and we will refund 3/4 of the first month’s fee. In effect, a week’s trial costs 1/4 of the price.
§4. Cancelling and pausing the subscription
- The Client may cancel the subscription in the portal or by emailing [email protected], under the rules set out in §3(6) of the Terms — no later than the day before the next billing period starts.
- Except under the guarantee described in §3, fees for billing periods that have started are non-refundable.
- If the subscription is paused, unused days in the billing period remain available for future use.
§5. Complaints
- Complaints concerning the guarantee and refunds may be sent to [email protected].
- The Service Provider will respond within 14 days of receiving the request.
§6. Final provisions
- The rules governing personal data processing are set out in Privacy Policy.
- Matters not covered by these terms are governed by Polish law, in particular the Polish Civil Code.
- The Service Provider reserves the right to amend these terms. Amendments take effect on the date they are published.
- All disputes will be resolved by the court with jurisdiction over the Service Provider’s registered office.
